The legislature is charged with determining what is criminal. With the passage of time, the legislature creates more and more laws that limits or even criminalizes different behaviors or activities. This may argumentatively infringe on our individual liberties as our behaviors or activities are perhaps criminalized. In 600-850 words, discuss the balance between law and liberty, include the following:

  1. Explain how a legislative body should balance the competing interests of liberty and the social interests of safety and peace.
  2. Explain how the justice system supports the decisions of the legislature.
  3. Explain why there is a separation of authority between the legislature and the justice system? (comp. 4.2)

Introduction: The Construct of Society

People live in harmony by obeying a single set of rules that have the force of law. These regulations form the social contract. John Stuart Mill’s piece-de-resistance focused on explaining what the social contract is and illustrating the benefits of joining one. That brings one to understanding the fundamental construct of society; an arrangement where people delegate the liberty to make their own rules to a centralized authority-the sovereign. That leadership is typically nominative, with the people selecting those they wish to represent their interests. It is the classical rationale for democracy since it gives rise to the concept of a parliament. Parliament is thus the central authority tasked with creating criminal law. Over time, there has been a noticeable gradual shift in the awareness of the real source of sovereignty. It has resulted in a situation where there is an apparent power struggle between the expression of individual liberty and the overarching control of societal behavior………..
