Most personal injury lawsuits are based on claims of negligence. A negligent person is the one who fails to exercise a reasonable duty of care that another reasonable person would have in the same circumstances. The person here does not intent to commit the offence or cause harm but their actions result in harming others. Intentional torts are however quite different in that the defendant here intended to cause harm. In a court of law, it can be proven that in the case of intentional torts, the person willingly and knowingly caused harm to the other party.
