The right to a speedy trial is a right protected under the Sixth Amendment. Often, that right is waived by the defendant to enable the attorney to fully prepare for the trial. However, there are instances where speedy trial is not waived, and the case is not brought within court-interpreted parameters. Let’s explore this facet of the Sixth Amendment.

You are the district attorney in the State v. Buckner case. You have a press conference scheduled after the announcement of the state supreme court’s decision in the case. Read the information on the case linked in the Resources.

Construct a statement explaining the decision to the public that balances respect for the court with the concerns of the victim’s family.

Atlanta, Georgia – The dismissal of the charges against Bobby Buckner was a ruling a trial court in Chatham County that was upheld unanimously by the Georgia Supreme Court. In 2003, Buckner was accused of kidnapping, sexually abusing, and killing, Ashleigh Moore, a 12-year-old girl after she surprisingly disappeared from home on April 18, 2003, in the morning. Since Buckner was Ashleigh mother’s boyfriend who lived with them, he was a prime suspect (WTOC, 2013). Therefore, he was arrested the next day. Earlier, Buckner was on probation which restricted him from being alone with children. However, Buckner violated the probation when he decided to be alone with three children including Ashleigh before the incident. As per the court documents at the time, Buckner pleaded guilty to committing sex crimes on other four children and confessed that he violated his probation……..
