As the arbitrator, in this case, I decide to sustain Kevin’s grievances because there was no reasonable cause for discipline. The supervisor, Ms. Martinez was not observant regarding Kevin’s back problem even though the nurse complained about it multiple times. I believe that as a supervisor, the health and well-being of your subordinates should be your primary concern because you need them to be excellent when they are performing their duties. Kevin’s decision to refuse to lift the patient, who was heavy as it was apparent in all testimonies, was justified because it could have put both him and the patient in danger. The consequences in such a situation would have been grave, and the heavy burden could have been on the hospital. Therefore, Kevin’s decision was selfless as he also acted in the interest of the hospital. Since Kevin’s issue is a health condition, the supervisor could have had a constructive conversation……
