Generally, the legal fact of immunity is relatively clear cut and, if the city had immunity, the lawyer would know this and you would not be writing to Ms. Dorite. Furthermore, unless Ms. Dorite is an unusually sophisticated client, you would have to spend a page or so on what legal immunity actually is, and she still would likely be confused. If I had to address such a legally complicated issue with a client, I would do it in person so there could be Q and A, and I would never ask my paralegal to communicate with a client about this issue.

In preparation for this week’s written assignment please review the facts of the interview with Ann C. Dorite and your summary from Module 02. Please also review your case briefs for Curatola v. Niles, 154 Ill.2d 201, 608 N.E.2d 882 (1993) and Gutstein v. City of Evanston, 402 Ill. App.3d, 929 N.E.2d 680 (App. Ct. 2010) from Module 04. After doing so write the following letters and submit them as one document.

  1. Write a transmittal letter in which you ask your client, Ann C. Dortie, to send in a copy of the police report made about the incident. Remember to put your letter on firm letterhead (you create it).
  2. Write a client opinion letter to your client, Ann C. Dorite, explaining whether she can sue the City of Lyons. The letter should address two issues, namely, whether the City of Lyons has immunity from Ms. Dortie’s law suit and whether the City of Lyons owes Ms. Dorite a legal duty to maintain the streets. Base your letter on the Curatola and Gutstein cases as applied to the facts of Ms. Dorite’s case.
