Every state in the United States has a law governing the validity of wills. Each state has a Wills Act which lays down the types of valid wills as well as the requirements for their revocation and execution (Wardle & Nolan, 2011). The primary type of will used in the U.S. is the attested will. The Wills Act outlines certain formalities that can help us determine the validity of an attested will. In Sarah’s case, she wrote her will on the hem of her slip. First, Sarah’s case may not reveal any testamentary intent because she used the hem of her slip to write her will. The matter of testamentary intent often arises where there would be a need for extrinsic evidence to be utilized to prove where it is testamentary. However, since most states do not allow extrinsic evidence, Sarah’s will may be invalid…..
